Trial begins today for former Miami football play

HAMILTON — The trial for a former Miami University football player accused of burglary is expected to start today, Oct. 13.

Zachary Marshall, 21 was indicted in July by a Butler County grand jury on a burglary charge for a May 21 break-in at a woman's room at Havighurst Hall. He has been suspended by the university and is not on the football team's roster.

Defense attorney Robert Peeler filed a motion to suppress statements made by Marshall, 21, a 2005 Mason High School graduate. But that motion was denied by Butler County Common Pleas Judge Michael Sage on Wednesday, Oct. 8.

Police Detective Walt Schneider testified he showed Marshall a shirt found in the room where the incident occurred.

"He said that's my shirt," Schneider said of Marshall. The officer then read Marshall his rights and arrested him.

Peeler said any statement Marshall made until the detective read him his rights should be suppressed because he was the "prime suspect" and was not free to leave the closed interrogation room.

Marshall is free on bond.
