Staff Report Updated 6:46 AM Friday, October 30, 2009

In summary, the federal indictments returned Thursady, Oct. 29, against former Butler County Commissioner Michael A. Fox allege that:

- he improperly benefitted from contracts with Butler County companies;

- failed to report income from those deals on his federal income tax return;

- committed four counts of mail fraud for failing to disclose conflicts of interest in Ohio ethics disclosure statements he mailed annually from 2004 through 2007.

Fox turned down the opportunity for a plea agreement, his attorney said.

Each count of mail fraud is punishable by up to 20 years imprisonment. Filing a false income tax return is punishable by up to three years imprisonment, plus taxes, penalties and interest.
