Monday, October 13, 2008

A Miami Twp. man was indicted Friday, Oct. 10, by a Warren County grand jury for allegedly raping a child in Warren County.

John David West, 65, of Silvercliff Drive, Dayton, was arrested after having repeated sexual encounters with a juvenile relative, according to Warren County Prosecutor Rachel Hutzel, who announced the indictments on today, Oct. 13.

Hutzel said that victim was under age 10, but she would not release any additional information out of respect for the victim's privacy. The offenses allegedly occurred in September and October. Hutzel said the rape was reported by the victim's mother.

West was charged with five counts of rape, a felony in the first degree, and five counts of gross sexual imposition, a felony in the third degree.

Friday's indictments also included:

• Troy D. Sams, 46, of South U.S. 42, Lebanon, was charged with two counts of aggravated vehicular assault, a third-degree felony, two counts of vehicular assault, a fourth-degree felony, and two counts of child endangerment, a fifth-degree felony.

Sams was driving his daughter and her friend, both teens, on Aug. 2 when he drove off U.S. 42 into a culvert, according to Hutzel. Hutzel said a blood test administered at the scene of the accident indicated Sams was intoxicated.

All three people in the vehicle sustained serious injuries. Sams received a broken collar bone, broken legs and broken fingers. His daughter, who was riding in the front passenger seat, received a broken pelvis and potentially has brain damage, according to Hutzel. The third passenger required more than 100 stitches and suffered a broken leg.

• Galen Smith, 38, of Edmon Court, Lebanon was indicted on one count of gross sexual imposition, a felony in the third degree, for allegedly having sexual contact with a child under age 13. Hutzel said Smith was related to the victim and the incident was reported by the victim's stepmother.

• Johnny Sorrell, 27, and Bradley Alcorn, 29, both of Lake Avenue, Franklin, were charged with receiving stolen property, a fourth-degree felony. Sorrell and Alcorn are alleged to be involved in several burglaries throughout the Tri-state area.

A raid of their house found three high powered shotguns that were allegedly stolen. Hutzel said that Sorrell and Alcorn potentially face charges in other counties throughout the state for their alleged crimes.
