TROY — A former high school assistant band director again faces two felony sexual battery charges after a Miami County judge allowed him to withdraw pleas to lesser charges.
Anthony Spahr, 29, of Troy asked to withdraw the pleas after learning the investigating sheriff's deputy, Bryce Adams, was being accused of inappropriate sexual conduct.

Common Pleas Judge Jeffrey Welbaum on Monday, April 28, granted Spahr's request. Trial is set for June 4.
Spahr was accused of engaging in sexual conduct with two teen girls last year in West Milton, where he was an assistant to the Milton-Union marching band.
Adams, who has not been charged, resigned last week from his job as a sheriff's school resource officer. The Montgomery County Sheriff's Office is investigating allegations he had a sexual relationship with a former Newton High School student in 2005.
