I only resisted a little

It was after 3 on a frosty December morning when a Englewood officer saw a white BMW accelerating quickly after failing to signal a turn. The officer caught up to the car as it pulled into a driveway.

The driver got out of his car, placed his keys on the trunk and told the officer several times he was home. The officer observed the gentleman had difficulty standing, appearing to sway from side to side. The officer asked the gentleman to get back in his car several times. The gentleman finally agreed and handed the officer his license.

The officer also detected the aroma of alcohol wafting from the gentleman. While awaiting backup, the officer had to again several times order the gentleman to retake his seat in his car. The gentleman apologize, telling the officer he was home.

When backup arrived, the officer asked the man to get out of his car for a field sobriety test. When asked if he had any weapons, the gentleman said no and “that he would show me,” the officer wrote in his report.

The gentleman then stripped down to his boxer shorts. It should be noted here that the temperature was around 30 degrees. After another back and forth with the gentleman about putting his clothes back on, the gentleman dressed himself.

Asked to perform the field sobriety tests, the gentleman responded he was home. Another back and forth ensued with the gentleman finally declining to take the tests. The officer then informed the gentleman he was under arrested for drunken driving and to put his hands behind his back.

The gentleman decided not to cooperate. In the pushing and shoving, the officer and his backup were able to handcuff the gentleman. In attempting to get the gentleman into a squad car, the gentleman elbowed the officer in the chest. It took the officers a while to get the gentleman into the squad car.

At the police station, the gentleman declined a breath test. Again, the officers had difficulty getting the gentleman back into the squad car for a trip to the county lockup. Finally the officer gave the gentleman a choice: get in the squad car or get Tased. The gentleman got in the squad car, but not before cussing out the two officers.

En route to the lockup, the gentleman said police should let him go because he was no longer a threat on the road and that he had resisted “”only a little.” The gentleman did not help his case by following that up with vague threats against the two officers, including that he had their number and the next time they met it wouldn’t go down easy, according to the report.

The gentleman spent the night in the county lockup, cited for drunken driving and resisting arrest.

Then he got to go back home.
