Board member, trustee say they’ll stay neutral
After three Madison Board of Education members called for the resignation of board member Todd Farler, the final member of the board has said he will remain neutral.
Today board member Brian McGuire, who did not state his opinion during Monday’s meeting, said he will leave it to Farler to decide whether or not to resign.
According to the opinion, a person serving both jobs would be required to participate in preparing competing budgets because the schools and township in the same county compete for tax dollars.
“I’m going to let Todd do what he feels is right,” McGuire said. “I think he’ll do what’s best for the school district. Whatever he decides to do, I will support him on it.”
Township trustee Alan Daniel also said he will remain neutral. Daniel said he could not speak for all the trustees, but in his opinion - and with his past 14 years serving the school board and 17 years as a trustee - he did not see a conflict.
“In all my experienced, I’ve never seen a conflict between the schools and the township. We work together,” he said. Daniel added that as the administrator Farler does not vote and as a school board member he can simply abstain from a vote on any issue that might be perceived as a conflict.
As of this afternoon, it remains unclear what future steps will be taken. The school board meets again at 6 p.m. Monday, Aug 11. The trustees have their regularly scheduled meeting Wednesday, Aug. 20.
According to the attorney general’s office, a possible step could be for the person involved to agree and resign. Other possible actions could be for the county prosecutor to bring the matter into court, or the individual involved could ignore the opinion; however, a taxpayer could bring a lawsuit.

While I am not an attorney, I believe that there is some case law relavent to such situations. I believe that when accepting the SECOND position, the individual may have automatically resigned from the first. I will be watching this closely as such conflicts are rampant within Middletown’s city Government.

According to Butler County Prosecutor Robin Piper, the Madison Board of Education could consider Todd Farler’s seat on the board vacated. Piper said case law suggests that if a person takes a second position that creates a conflict, the first position becomes vacant. Farler is now on his second term as a board member and took his position as township administrator in January.

Great news, Meagan!! I hope that Piper takes a look at the Middletown City Council!! If all seven seats are actually VACANT, perhaps we can get seven people on board who will do something to save our sinking city!

I think most people are not considering the word “Opinion” that does not mean that it is law or a fact just an “opinion” that Mr. Farler’s positions are a confilt. Mr. Farler can do exactly what Mr. Daniel stated if it would appear to be a confilt just don’t vote on an issue. Mr. Farler is a good and honest man. Not everyone in the Madison Community feels so negative about him.
